Whistler Skier is Suing Californian Snowboarder After Serious Injuries Suffered During Collision

A skier from Whistler, BC, is suing a snowboarder for injuries she says she sustained while standing at the side of a run in December 2021.

Marie-Christine Abousleiman, also known as Marie-Christine Riachi, is suing Armin Motekalem of Sunnyvale, CA, after she was injured when he allegedly hit her on Crabapple trail on December 22.

Abousleiman, who was wearing a helmet, was at a complete stop at the side of the trail. Conditions on the day were clear, and she was facing downhill.

She was struck from behind by Motekalem, who was “snowboarding at high speed.”

As a result of the collision, Abousleiman has suffered a concussion, a right shoulder injury, chronic pain, multiple upper arm fractures, possible multiple rib fractures, contusions, and abrasions, sleep disruption, mood disruption, and generalized pain and suffering report Times Colonist. She is suing for general damages, aggravated damages, past and future loss of housekeeping capacity, and future care expenses.

The lawsuit claims Motekalem failed to keep himself under control, was unable to adhere to the Alpine Responsibility Code or Skier Responsibility Code, failed to yield right of way, snowboarded without due care and attention, snowboarded too fast, failed to warn the plaintiff, and failed to keep a proper lookout.

None of the allegations have yet been proven in court.
